By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
By accessing or using the Service, you confirm that you have read, understood, and accepted these Terms, together with any policies referenced within them, including the Privacy Policy, Cookie Policy, Audit Participation Terms, and Rating Usage Guidelines.
If you are using the Service on behalf of an establishment, organization, or other legal entity, you represent that you are authorized to bind that entity to these Terms, in which case "you" refers to that entity.
Aboera is an independent customer service and quality audit platform focused on evaluating customer experience standards by conducting anonymous audits across selected premium and luxury-facing sectors and publishing ratings based on those audits.
The Service includes the website, audit findings, ratings, observations, editorial content, directories, nomination system, informational materials, and any features made available through the Service.
Aboera ratings are issued based on professional evaluation against a defined framework. Ratings are not advertisements, endorsements, or guarantees of future performance. Aboera operates independently of the establishments it evaluates. All ratings, observations, and published materials reflect Aboera's own methodologies, standards, and editorial judgment.
Aboera's ratings, observations, commentary, and other published materials are opinions based on its own standards, review processes, experiences, and available information at the time of publication.
They are provided for general informational purposes only and do not constitute guarantees, certifications, promises, endorsements, or statements that every future experience will match prior findings.
Individual experiences may vary over time, by visit, by staff, by season, or by circumstance.
Nothing on the Service constitutes legal, financial, medical, travel, or other professional advice.
You must be at least 18 years of age and capable of forming a binding contract under applicable law to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
Subject to these Terms, Aboera grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, lawful, and non-commercial purposes unless otherwise authorized in writing.

You may submit nominations, messages, and other communications to Aboera ("Submissions") through the Service.
By making a Submission, you confirm that:
You grant Aboera a non-exclusive, worldwide, royalty-free license to use, store, review, reproduce, and process Submissions for internal operations, evaluation consideration, service improvement, and related business purposes.
Aboera is under no obligation to act on any Submission. Submitting a nomination does not entitle you to any compensation, recognition, or guarantee of action.
Aboera audits are conducted anonymously and independently. Auditors evaluate establishments against criteria appropriate to each category and pay published rates as ordinary guests. Aboera conducts evaluations according to its own internal methodologies and standards. Evaluation formats, timing, scope, frequency, and publication decisions remain solely at Aboera's discretion.
Payment for the Service does not guarantee any rating outcome.
Aboera does not accept bribes, undisclosed incentives, gifts intended to influence results, or any attempt to improperly affect an evaluation during the audit.
If an establishment attempts to identify an auditor, alter treatment solely for the auditor, interfere with methodology, or otherwise compromise the integrity of the process, Aboera may suspend, terminate, withdraw, pursue legal action, or decline the audit, and may refuse future participation.
Ratings reflect the conditions observed during a specific audit period and are subject to change through periodic re-audit. A rating may be awarded, modified, withheld, revised, suspended, or withdrawn at Aboera's sole discretion. Aboera does not guarantee that any rating, audit, or finding will remain unchanged.
Aboera does not engage in public disparagement. Establishments that do not receive a rating are not characterized negatively; absence of a rating reflects only that the conditions for publication were not met.
All content forming part of the Service, including text, branding, graphics, logos, design elements, the Aboera name and marks, photographs, audit frameworks, ratings, rating systems, directories, original materials, editorial commentary, related intellectual property, and software, is the property of Aboera and is protected by copyright, trademark, and other intellectual property laws. No such content may be copied, reproduced, republished, distributed, modified, or used without prior written permission except where expressly permitted.
The Aboera name, logo, and rating tier designations may not be used in commerce, promotion, or public communications, by any establishment, third party, or other person without prior written authorization. Any unauthorized use, reproduction, or modification of Aboera marks or content is strictly prohibited.
Establishments that have received an Aboera rating may reference that rating in their own communications subject to separate guidelines published by Aboera (see Rating Usage Guidelines).
Establishments that consent to be evaluated by Aboera are subject to additional terms set forth in the Audit Participation Terms. Participation does not influence or guarantee any specific rating outcome. Aboera retains sole discretion over audit methodology, scope, scheduling, and publication.
Information provided through the Service, including ratings and editorial content, is for informational purposes only. Nothing on the Service constitutes legal, financial, medical, travel, or other professional advice. You should not rely on Aboera ratings as the sole basis for any decision and should make your own independent inquiries before engaging any establishment.
The Service is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Aboera disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, availability, or uninterrupted operation.
Aboera does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Aboera does not warrant the accuracy, completeness, or timeliness of any information on the Service, except as expressly stated.
To the fullest extent permitted by applicable law, Aboera and its owners, officers, directors, employees, agents, contractors, affiliates, and representatives will not be liable for any indirect, incidental, special, consequential, reputational, punitive, or business damages, or any loss of profits, revenue, data, business, goodwill, or opportunity arising out of or relating to the Service.
Where liability cannot be excluded, Aboera's total aggregate liability shall not exceed one hundred U.S. dollars (US $100).
You agree to indemnify, defend, and hold harmless Aboera and its owners, officers, employees, contractors, agents, affiliates, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:
Aboera reserves the right to modify, suspend, or discontinue the Service, in whole or in part, at any time and without notice. Aboera may also restrict or terminate your access to the Service at its sole discretion if you violate these Terms or for any other reason.
The Service may contain links to third-party websites, platforms, or services. Aboera does not control and is not responsible for their content, security, availability, or practices.
These Terms shall be governed by the laws of the jurisdiction in which Aboera is legally established, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction and venue in those courts.
Aboera may update these Terms from time to time. The latest version will be posted on this page with an updated effective date or last updated date. Material changes will be communicated through the Service where reasonable. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with any policies or documents referenced herein, constitute the entire agreement between you and Aboera regarding the Service.
